DJ can be played even after 10 pm at night
In India, under the Noise Pollution (Regulation and Control) Act 2000, there is a ban on using DJ after 10 pm till 6 am. But there is no compulsion to do so. DJ can be used in parties after 10 pm till 12 am by following some rules. In this, the sound of the DJ has to be kept at such a level that no one is disturbed.
If someone wants to play DJ after 10 pm, then he has to keep the sound below 70 decibels. If it is more than this and someone complains, then action can be taken. Therefore, DJ can be played for 2 more hours after 10 pm, but within a sound limit.
What action can be taken?
The Indian Constitution has given some fundamental rights to the citizens of the country. These include the right to live in a noise pollution free environment. No one can disturb this. If someone plays DJ or any other loudspeaker at night, then a case can be registered under Section 290 and 291 of the IPC. Under this, there is a provision for both jail and fine.
You can also complain in court
If someone in your area uses DJ or loudspeaker at high volume, then you can directly approach the court against him. In which you can demand action from the Supreme Court under Article 32. You can also file a case in the High Court under Article 226.
