Allahabad High Court said, children of jail prisoners have a fundamental right to get education in regular schools outside the jail. The education and all-round development of such children cannot be imprisoned within the walls of jail. The government should make special provisions and policies for such children and present them with an affidavit in the court by 20th November.
This order has been given by the court of Justice Ajay Bhanot while hearing the bail application filed on behalf of petitioner Rekha. The petitioner is in jail in the case of murder and kidnapping in 2023 of Modinagar police station area of Ghaziabad. During the hearing, the court found that the petitioner’s five-year-old child lives with him in jail. When the court obtained information about his education, it came to light that he was studying in a crèche school located in the jail premises, which is designed only for the children of prisoners.
Earlier, during the hearing, the Director General (Prisons) and Principal Secretary (Women and Child Development) had filed an affidavit and told the court that there are many children in the state who live in jail with their prisoner parents. The state government is committed to their care. The government is preparing a scheme to enroll such children in regular schools and provide other support systems in various CCIs.
The court directed the Principal Secretary, Women and Child Development Department, Principal Secretary (Prisons) and Director General (Prisons) of Uttar Pradesh to prepare the final policy in this regard and present it with an affidavit in the court by November 20.
