Law On Viral Video: You will see many videos going viral on social media, many of these videos are of people’s private moments which often go viral. Or are made viral by other people against their will. In the year 2017, the Supreme Court has considered the right to privacy as a fundamental right.

And according to the Constitution, violating anyone’s fundamental rights is a legal crime. Therefore, if anyone makes someone’s personal video viral against his/her wishes. So he may be punished under the law and may even have to go to jail. Let us know how many years the jail term can be in this case.

Can be imprisoned for up to 3 years

Indian citizens have got fundamental rights under Article 21 of the Indian Constitution. No one can stop them from using them. In which now Right to Privacy has also been considered as a fundamental right. That means no one can do such work. Due to which a person’s privacy is in danger. There is a provision for punishment for doing so. If a person makes a video of someone against his will and then makes it viral even if he refuses.

So he is found guilty of violating physical privacy under Section 66E of the Information Technology Act, 2000 i.e. IT Act. Under this section, if any person is found guilty of violating privacy, then there is a provision for action against him. That is, if anyone has taken a photo or video of someone without his permission and later shared it, then action can be taken against him under this section. This crime can result in a jail term of up to 3 years and a fine of up to 2 lakhs.

Punishment even if the photo is tampered with

According to section 67 of the ID Act, if someone tries to make your photo obscene by tampering with it using software or other electronic devices, then there is a provision for action against this as well. For doing this, 3 years of jail and a fine of Rs 5 lakh can be imposed. At the same time, cases of deep fake are also coming to the fore these days. In such cases, action can be taken under sections 66C, 66E and 67.
