Now the question arises that if a person is traveling in a train without a ticket and the passenger dies in a train accident, will his family also get compensation? Let us tell you what the rules and laws say in this regard.

First know about the major train accidents in the country

Earlier this year, i.e. in January 2024, the Bengaluru-Howrah Superfast Express collided with a freight train near Karnataka. About 50 people were injured in this accident and more than 15 people lost their lives. After this comes the Balasore train accident. More than 300 people lost their lives in this accident and more than 1000 people were injured. At the same time, in the year 2022, three bogies of Mumbai-Howrah Lokmanya Tilak Express derailed near Birbhum district of West Bengal. Many passengers were injured in this accident. Rules for travelling without ticket and compensation

Railway Claims Tribunal: This is where cases of problems related to compensation to the family of people killed in a railway accident are heard. In 2014, a man named Deepak Thackeray died after slipping from a moving train. After his death, when the family demanded compensation from the railways, the Railway Claims Tribunal (RCT) refused to give compensation saying that the deceased Deepak Thackeray did not have a ticket for the journey.

The family opposed this and the matter reached the Bombay High Court. However, the Bombay High Court also upheld the decision of the RCT in this case and said that the railways will not give compensation to the passenger without a ticket. This means that if you do not have a ticket during a train accident, then you are not entitled to the compensation given by the railways.
