What is a magistrate?
Magistrate handles the legal affairs of just one district like a judge but does not have the same power as a judge. Magistrate cannot award death sentence or life imprisonment. The highest post in the Magistrate is CJM i.e. Chief Judicial Magistrate (CJM). Magistrate hears revenue cases and minor civil cases are also heard by District Magistrate (DM) or Sub Divisional Magistrate (SDM), but this does not mean that only the administrative officer gets the Magistrate designation.
What is justice?
Justice is the highest position in the judiciary, it is called Justice in Hindi. They conduct hearings in the High Court or the Supreme Court. Their first duty is to protect the constitutional rights of common citizens. Cases of violation of fundamental rights are presented directly to the High Court or the Supreme Court and only the justices hear them.
Difference between Judge, Magistrate and Justice
Although all these three are basically judges, but their designations are determined on the basis of seniority and responsibilities. However, the process of their appointment is also different. The District Court Judge is appointed by the High Court. They remain part of the judiciary. While the District Magistrate or Sub-Divisional Magistrate is appointed by the state government and they are part of the executive.
The appointment of justices is done in accordance with the provisions of Article 217 of the Constitution of India, after consultation with the President of India and the Governor of the concerned state.
