Muslim Women Rights Day: Five rights due to which Muslim women are targeted


The Indian Constitution is the same for all people living in the country. In India, the legal process and court decisions are also the same for people of every religion and caste. But personal laws are different according to religions. All Muslims in India believe in Muslim Personal Law (Sharia), through which marriage, divorce, succession, inheritance and charity related works are done among Muslims. But do you know what are the anti-women rules in Muslim Personal Law? Today, on Muslim Women’s Rights Day, we will tell you about it.

It is worth noting that 5 years ago on August 1, 2019, triple talaq was legally declared a crime. After which, 2 years later, the central government had decided to celebrate August 1, the day when triple talaq was declared a crime, as “Muslim Women’s Rights Day”. After which every year 1st August is celebrated as Muslim Women Rights Day.

What is the anti-Muslim law

• Talaq-e-Ahsan: In this, the husband can divorce his wife when she is not menstruating. However, it can also be taken back in three months, which is called ‘Iddat’. If the divorce is not taken back even after the Iddat period is over, then the divorce is considered permanent. After this, the husband and wife get separated.
• Talaq-e-Hasan: In this, divorce has to be given three times in three months. For this, the husband can give divorce once a month by speaking or writing it. However, in this also divorce is given only when the wife is not menstruating. In this also there is a provision to take back the divorce before the Iddat period is over. In this process, the divorced husband and wife can get married again. But this happens only when the wife marries another person and divorces him. This process is called ‘Halala’.
• Talaq-e-Biddat: It is also called triple talaq. In this, the husband can divorce his wife by saying or writing three times in one go. In this, the marriage is broken immediately by saying talaq three times only. However, now giving triple talaq is illegal, there is a provision of punishment up to 3 years for doing so. In this process also, the divorced husband and wife could remarry, but for that the process of Halala is adopted. 
• Divorce According to Muslim Personal Law, in view of the Muslim Women (Protection of Rights on Divorce) Act 1986, a divorced Muslim woman is not entitled to claim any alimony under Section 125 CrPC.
• According to Islamic law, a Muslim man can marry four women at the same time. 

Let us tell you that when you look at these Islamic laws, you will find that all these laws are anti-women. Because according to these laws, a man has more rights than a woman, due to which he can divorce his wife i.e. a Muslim woman by using these rights.
