The Supreme Court on Monday (September 30, 2024) asked IIT-Dhanbad to grant admission to the Dalit youth who lost his seat due to non-payment of fees. The Dalit youth could not take admission in the Indian Institute of Technology (IIT)-Dhanbad due to missing the deadline for depositing fees. Now the court has asked the institute to give him admission in B.Tech course.
According to news agency PTI, Chief Justice D.Y. Chandrachud, Justice JB Pardiwala and Justice Manoj Mishra said, ‘We cannot deprive such a talented young man of opportunity. He cannot be left in the lurch. The Supreme Court, using its extraordinary powers under Article 142 of the Constitution, directed IIT-Dhanbad to admit Atul Kumar to the Electrical Engineering B.Tech course of the institute.
The bench said in its order, ‘We believe that a brilliant student like the petitioner, who belongs to a marginalized group and who has made every effort to get admission, should not be deprived. We direct that the candidate should be admitted to IIT-Dhanbad and he should be allowed to remain in the same batch in which he would have been admitted had he paid the fees.’
Article 142 of the Constitution gives the Supreme Court the right to pass any order in the interest of justice. The parents of Atul Kumar (18) failed to deposit Rs 17,500 as fees by June 24, which was the last date to deposit the required fees. Atul Kumar’s parents had also approached the National Scheduled Caste Commission, Jharkhand Legal Services Authority and Madras High Court to save the IIT seat.
Atul Kumar, resident of Titora village in Muzaffarnagar district of Uttar Pradesh, is the son of a daily wage laborer and his family belongs to the Below Poverty Line (BPL) category. The National Commission for Scheduled Castes also expressed its inability to help them. Since Atul Kumar had appeared for the JEE exam from a center in Jharkhand, he also approached the Jharkhand State Legal Services Authority, which advised him to approach the Madras High Court, since the exam was conducted by IIT-Madras. The High Court had asked Atul Kumar to approach the Supreme Court.
