The National Green Tribunal (NGT) has sought answers from the Delhi government and others regarding alleged “misuse” of forest land allotted for afforestation. The green body was hearing a petition which claimed that 125 bighas (about 30 hectares) of gram sabha land in Kharkhari Jatmal village of Najafgarh was allotted to the forest department for afforestation in 2005 and the Lieutenant Governor had allowed the pollution to take place. This allocation was approved to reduce pollution and increase greenery.

The petition alleged that this land was misused as the land mafia took over it and started illegal construction and unauthorized agricultural activities. A bench of NGT Chairperson Justice Prakash Srivastava, in its January 2 order, said the petition also alleged that the demarcation of the land was incomplete and there was illegal extraction and sale of groundwater from the area.

“Issue notice to the respondents to file their response/reply by way of affidavit before the tribunal at least one week before the next date of hearing (April 22),” the bench said, comprising Justice Arun, a judicial member. Kumar Tyagi and expert members were also present. The defendants in the case are Delhi Government, Deputy Conservator of Forests, Forest and Wildlife Department and the concerned Sub-Divisional Magistrate.
