Parliament Winter Session Pratibha Bhowmik Gave Answer In Lok Sabha About EWS Reservation


Parliament Winter Session: The government said in Parliament on Wednesday (December 7) that there is no proposal to make any changes in the existing system of reservation. Union Minister of State for Social Justice and Empowerment Pratima Bhowmik gave this information in a written reply to a question in the Lok Sabha.

Pratima Bhowmik made this comment about a month after the Supreme Court upheld 10 percent reservation for economically weaker sections. The government was asked whether the government has any plan to give relaxation in the limit of 50 percent reservation. In response to this, the minister said that there is no proposal to change the existing system of reservation.

What is the matter?

On November 7, the Supreme Court had given its verdict on upholding 10 percent reservation for Economically Weaker Sections (EWS) in admission to educational institutions and government jobs. In the year 2019, all the five judges of the Constitution Bench, which announced the upholding of the EWS reservation, had replied that the 103rd Constitutional Amendment cannot be called a violation of the basic structure of the Constitution.

Let us inform that the ruling Dravida Munnetra Kazhagam (DMK) in Tamil Nadu filed a review petition regarding EWS reservation on Monday (December 5). According to it, “It is submitted that it is clearly in error as it directly nullifies the 1992 judgment of a nine judge Constitution Bench in Indira Sawhney v. Union of India…which declared that It was held that reservation cannot be based on economic grounds and such interpretation was done on the basis of Articles 14, 15(1) and 16(1) and not merely on the basis of Articles 15(4) and 16(4) .”
