A 25 year old pregnant woman died due to doctor’s negligence. The post-mortem has revealed the insensitivity shown by the doctor and the nursing home. This incident, which happened ten years ago, was being heard in the State Consumer Commission. After listening to both the sides, commission members Rajendra Singh and Vikas Saxena ordered to pay compensation of about Rs 2 crore to the doctor and the nursing home. Ten years’ interest is also included in this amount.

Priya Singh, daughter of complainant Vijay Bahadur Singh of Varanasi, was married to Pankaj Singh. After becoming pregnant, Priya came to live with her father in June 2012. Priya showed Dr Saroj Pandey to her nursing home Shyam Maternity in Varanasi. He got many tests done. Due to labor pain on January 30, 2013, Dr. Saroj got admitted to her nursing home. Gave birth to a son through operation and then kept him in a private room. The condition became serious at night. Priya died the next day due to lack of proper treatment. His post-mortem was conducted the same day, which found that there was excessive bleeding in the stomach and death was caused by the formation of a blood clot. Priya was only 25 years old.

Commission member Rajendra Singh looked at the entire case along with the post-mortem report. In which it became clear that there was serious medical negligence in this case due to excessive bleeding and blood clotting. In this case it was also found that post-operative care was of low standard. Immediately the hospital and the doctors could not figure out what the patient was suffering from and he died within a day. Today his son is ten years old.

Commission gave five orders to Dr. Saroj

– Rs 50,000 should be given to the complainant as medical expenses.

– Rs 30 lakh should be given for medical negligence. Half of this amount will be deposited in a nationalized bank for 10 years, which will be given to the son of the deceased when he attains majority.

– Rs 10 lakh should be given for mental torture and depression.

– 30 lakhs should be given to the complainant. Half of this amount will also be deposited in a nationalized bank for 10 years, which will be given to the son of the deceased when he attains majority.

– 30 lakhs should be given in respect of deficiency in service. (12 percent interest will have to be paid on all these dues from 2013 onwards.)
