Right to Privacy: Nowadays everyone uses a smartphone. A lot of work can be done with the help of a smartphone. People do many things with it like watching videos, listening to music and taking photos. Now people go anywhere. Wherever they are, they take photos of that place. And share them on social media.
But let us tell you that you cannot share anyone’s photo on social media without their consent. Doing so comes under the category of crime. If you are sharing a room with someone and you click a photo of your roommate and post it. Then you can get into trouble. Let’s know what the law says about this and what are the rules.
Right to privacy is violated
Every citizen has been given some fundamental rights in the Constitution of India. Under Article 21 of the Constitution, every person has the freedom to live his life in his own way. Now the right to privacy has also been added to these fundamental rights. Which is also called the right to privacy. And if a person takes a photo or makes a video of someone without his consent.
And uploads it somewhere on social media. So this is a violation of his privacy i.e. violation of the right to privacy. Doing this can get you punished. That is, if you take a photo of your roommate without his consent and post it, then you can also be punished for this. If this happens, anyone can go to the police station and complain about this matter.
Action can be taken under IT Act
There is a provision to take action in such cases under Section 66 of the ITI Act, 2000. If someone posts a photo or video of someone on social media without their consent, a case can be registered. Under the ITI Act, there is a provision of punishment up to three years in these cases.
Along with this, a fine of up to Rs 2 lakh can also be imposed. Therefore, you cannot take photos or make videos of anyone without their permission. If you want to do this, you will have to first take permission from that person. If you take photos or make videos without permission and share them on social media, you can get into trouble.
