Right To Sleep: Every Indian citizen living in India has some rights constitutionally, which cannot be taken away by anyone. One of these rights is peaceful sleep. If any person or organization unnecessarily disturbs the sleep of an Indian citizen, then it is a violation of the fundamental rights of that person, which are given to him by the Indian Constitution.

The matter was that the Bombay High Court was hearing a petition filed by Ram Israni, a senior citizen of Maharashtra. In this petition filed by Ram Israni, it was said that ED wanted to interrogate him in a money laundering case, to which he had also said yes. But even after this, ED officials took his statement from 10 pm to 3:30 in the morning.
The High Court rejected this petition, but it definitely raised questions on such action of ED. According to the court, the right to sleep or take a nap is a human and basic need. Depriving someone of this is a violation of the person’s human rights. Apart from this, you will remember that in the year 2012 also, the Supreme Court had given a similar statement on the police action in Ramlila Maidan of Delhi.

Actually, getting peaceful sleep comes under the Right to Life under Article 21 of the Constitution. In the Ramlila Maidan case, the Supreme Court judge had reprimanded the Delhi Police and said that getting peaceful sleep is a fundamental right of a person. It is essential for life and it cannot be taken away from any person. However, the court had also made it clear here that you have the right to sleep, but at the right place. It should not happen that you are sleeping in the court or in the Parliament.
