Supreme Court ordered to start proceeding against returning officer Anil Masih Chandigarh Mayor election BJP AAP


Chandigarh Mayor polls: The Supreme Court on Tuesday (February 20) has given a big decision regarding the Chandigarh Mayor elections. The Supreme Court has declared Aam Aadmi Party candidate Kuldeep Kumar as the Mayor of Chandigarh. Along with this, the court has considered Returning Officer Anil Masih as an accused and has ordered to issue a notice against him.

In view of the alleged irregularities in the Chandigarh Mayor elections, the Supreme Court ordered re-counting of votes. Along with this, orders were also given to include the cross marked ballot papers in the counting after voting.

How will the case be prosecuted against Anil Masih?

The Supreme Court says that a suitable case is made out to initiate proceedings under Section 340 of CrPC against Chandigarh Mayor Election Returning Officer Anil Masih. The Supreme Court directed the Registrar Judicial to issue a notice to him (Anil) and show cause why legal action should not be taken against him.

Canceled votes went in favor of AAP

The Chief Justice-led bench, after examining the ballot papers, said that the eight votes which were declared invalid were in favor of Aam Aadmi Party candidate Kuldeep Kumar. The Supreme Court said that it is clear that the presiding officer (Anil Masih) deliberately invalidated 8 ballot papers. Therefore, we declare Aam Aadmi Party councilor Kuldeep Kumar as the winner and Mayor of Union Territory Chandigarh.

Anil Masih tampered with the ballot papers

The Supreme Court made it clear on Tuesday that it is not canceling the entire electoral process. A bench headed by Chief Justice DY Chandrachud said that it is clear that Anil Masih had tampered with eight ballot papers. Only after this the possibility of a case being filed against Anil Masih has increased.
