Kiren Rijiju on Uniform Civil Code: Union Law Minister Kiren Rijiju responded in Parliament on Thursday (February 2) on the issue of Uniform Civil Code (UCC). He said in the Rajya Sabha that the government had requested the 21st Law Commission of India to examine various issues related to the Uniform Civil Code and make recommendations thereon. The term of the 21st Law Commission has ended on 31.8.2018.
Kiren Rijiju said in the Rajya Sabha that according to the information received from the Law Commission, the matter related to UCC can be taken up for consideration by the 22nd Law Commission. Therefore, no decision has yet been taken on implementing the Uniform Civil Code.
The issue of UCC was echoed in the House earlier also
Earlier in December last year, Law Minister Kiren Rijiju had told the Rajya Sabha that states have the right to enact personal laws governing issues such as succession, marriage and divorce in their effort to secure a Uniform Civil Code (UCC). The minister made these remarks in response to a question asked by John Brittas, a member of the Communist Party of India (Marxist), who asked whether the Center was aware of the states making their own laws with regard to UCC.
What did the Law Minister say?
On this, Kiren Rijiju said, “Yes, sir. Article 44 of the Constitution provides this right to the state.” The Law Minister had said, “Personal laws such as succession, will, marriage and divorce, pertain to List III-Entry 5 of the Concurrent List of the Seventh Schedule to the Constitution, and therefore the States also have the right to legislate on them.” Earlier, when this issue was raised in Parliament, the Law Minister had said that the Law Commission would examine the matter in detail.
