Allahabad High Court: Allahabad High Court has expressed concern over the issuance of fake marriage certificates by organizations for marriage registration in UP and has sought a reply from the UP government in this regard. The High Court has said that organizations are distributing marriage certificates fraudulently for marriage registration. The court has also said in its decision that Ghaziabad and Gautam Buddha Nagar districts adjacent to the country’s capital Delhi have become a big center for fake marriage certificates. Many organizations are active in this fraud work.

The High Court has made a harsh comment in this matter and said that this is not possible without the connivance of the officers and employees of the marriage registrar office. The involvement of the police and administration cannot be ruled out. According to the court, marriages are being registered without a legal marriage certificate with the connivance of the officers of the registrar office. The High Court has summoned the Assistant Director General of Ghaziabad and Gautam Buddha Nagar in this regard and asked them to present the record of the last one year. The court has also asked the officers of both the districts to appear in the court on the next hearing.

The High Court summoned the reply from the UP government
The High Court has also sought a reply from the UP government in this matter. The court has asked the Director General of the Registration Department of UP to present the details of the last one year. The Director General has been asked to present the details of district-wise marriage registrations from August 1 last year to August 1 this year. The record of how many marriages were registered in which district in the last one year, which marriage certificate was used for registration and what other documents were presented, will have to be presented in the court. The court has asked the UP government to curb fake marriage certificates and registrations.

While hearing the case, a single bench of Justice Vinod Diwakar said that most of the registrations through fake marriage certificates are done through the court to get police protection. The High Court made this harsh comment while hearing the petition of Shani Dev, a resident of Etawah district. Shani Dev, who had a love marriage, has pleaded for protection from his family members, saying that his life is in danger. He has claimed to have got married on 03 June 2007 in Arya Samaj Mandir, Greater Noida.

Security cannot be given on the basis of fake documents
The court said that every person is free to choose his/her life partner and live in a marital relationship or live-in-relationship, but protection cannot be given on the basis of fake documents. Many fake organizations are active in the state to conduct marriages. Most of such societies or organizations are located in Noida or Ghaziabad. The court has also asked the president or secretary of the Lucknow-based Arya Pratinidhi Sabha to be present in the court on the next hearing. The court has made a harsh comment that this court has seen “10-15 cases every day” where marriages have been done through fraud or fake documents. The next hearing of this case in the High Court will be on August 6.
