In such cases, the accused not only has to face the already ongoing case, but will also have to face legal action in the new murder case. This means that now separate cases of two murder cases will be going on against him. If the accused is found guilty in both the cases, he can be punished in both the cases.

What the law says

Indian Penal Code (IPC) Under this, in cases of murder, action is taken against the accused under Section 302. If the charges against the accused are proved, the maximum punishment he can face is death or life imprisonment. However, now since the Indian Justice Code (BNS) has come, section 103 related to murder has been added to it.

Murder in jail

Also, while sentencing the accused in a murder case, the court seriously considers many aspects. Like the murder was done suddenly or the murder was planned or the murder was done in self-defense. Only after considering these aspects, the court sentences the person guilty of murder.

If a person has planned the first murder, then he can be sentenced to life imprisonment or death sentence. But if the same person commits a second murder in self-defense while in jail, then it is possible that the court may not give death sentence to the person in this case. However, the final decision in any case is what the court decides.
