Who declares a criminal as a gangster?
There is a complete process to declare a criminal as a gangster. According to the law, when a criminal commits a crime with a gang or commits a crime by taking the help of different persons for different crimes, then that person is declared a gangster. Before declaring a criminal as a gangster, the in-charge of the police station concerned with the crime prepares a chart, which is called a gang chart.
This chart contains all the information related to the criminal and the crime. After this, the station in-charge i.e. SHO presents this chart in front of his senior officers. From here, this chart passes through the SP and reaches the DM of the district and then the DM i.e. District Magistrate, after examining this chart, approves it. After the approval of DM, all the criminals present in this chart are declared gangsters.
What is the punishment under Gangster Act?
The provision of punishment under the Gangster Act may vary from state to state, as this law is implemented by the states. However, generally for crimes under the Gangster Act, the culprit can be sentenced to 5 to 10 years. In some cases, this punishment can even extend to life imprisonment. Talking about Uttar Pradesh, there is a provision of minimum two years and maximum punishment of 10 years under the Gangster Act in UP.
